We are Sundalah and this website is for the Sundalah CommUNITY Wellness Festival (SCWF) Event running from 7 April to 21 April 2024.
Our website address for the festival is: festival.sundalah.com.au (the “Site”).
This document sets forth the Terms and Conditions for the Festival and this Site.
For the Sundalah Wellness Festival
Passes & Tickets – General Info
All Pass and Ticket Sales are final. There will be no refunds unless extenuating circumstances can be proven. These must be expressed in writing to festival@sundalah.com.au. There is no guarantee of a refund in these cases.
Each Pass or Ticket is purchased for an individual and cannot be transferred to someone else. Individuals may be required to prove their identity on entry to any event, class, workshop or talk.
If you do not see your Pass or Ticket and/or Purchase Receipt in your inbox, make sure to check your junk/spam folder before contacting us.
Please bring your Pass or Ticket with you to each Event, Class, Workshop or Talk. This will help you to prove your eligibility to enter if there are issues with attendee lists etc. You may, or may not, be asked for your Pass or Ticket on entry. You may show your Pass or Ticket on your mobile device or on a printed version.
Only purchase individual Festival Passes or Tickets from this Site. If you purchase from another source, you are purchasing a counterfeit or invalid Pass or Ticket. (Note: 15th Birthday Celebration VIP Packages may be requested via hello@sundalah.com.au.)
If you need to change any of your details, including your email address, after purchase, you must contact us via email at festival@sundalah.com.au. We will update your details and confirm this via return email to both the old and new emails addresses as required.
Waitlists
If you have requested to be placed on a Waitlist, there is no guarantee that you will be able to attend the requested class, workshop or talk. However, if we contact you to offer you a place you must reply promptly in order to secure your place (within 24 hours), otherwise we may move to the next individual on the Waitlist and you will miss out.
Events, Classes, Workshops and Talks
Classes, workshops and talks are subject to change without notice.
Any events, classes, workshops and talks over the 2 week festival may be cancelled due to unforeseen circumstances. If this occurs, all efforts will be made to offer options or alternatives. Refunds however will not be given unless the whole 2 week Festival is cancelled.
Where an event, class, workshop or talk address is not displayed on this website, you will be notified of the location via email after you have purchased your pass and completed you RSVP to the selected class, workshop or talk.
Safety Information
In the event of an emergency, please follow the directions of the event staff and listen for announcements.
If severe weather is observed in the area of an event, we will make announcements such as the severity of the storm, and any evacuation and/or event suspension procedures.
Please be prepared for outdoor events, by bringing items such as sunscreen, appropriate clothing, hats, sunglasses, raingear and water. Sunscreen and water refill stations will be provided where possible for reapplying sunscreen and refill of your reusable water bottles.
If you experience strange behaviour or see something unusual or suspicious, please say something. Report suspicious behaviour to any security, staff or medical team members.
Any Pass or Ticket holder that directly or indirectly interferes with the enjoyment of Festival Events may be asked to leave any venue and may be subject to arrest and prosecution by Local or State Authorities.
There will be a First Aid Care Station at the large events. Please do not hesitate to visit medical staff if you need attention.
The Sundalah Wellness Festival is a smoke free event.
Please consider being Plastic Free when attending our Festival.
Attendee Liability Waiver and Release
By purchasing a Sundalah Festival Pass and participating in the Sundalah CommUNITY Wellness Festival (SCWF), you are deemed to have agreed to our Waiver as follows:
“I am aware that the organisers, teachers and associated volunteers at events, classes, workshops and talks are here to serve me (and my child/ren) by sharing their knowledge of, and instructing me in a variety of activities.
I recognise that these activities may, at times, be physically challenging. It is my responsibility to ascertain any medical or other condition that may prevent my participation in any events, classes, workshops or talks at the SCWF. By my participation, I represent that I (and my children) are physically fit and have no medical or other conditions that would in any way make it harmful for myself, or my family to participate.
I agree to take full responsibility and assume full risk for any injury or loss I might suffer while participating in events, classes, workshops or talks that are part of the SCWF. I waive any claim, at any time, for an injury or loss of any sort against the organisers, teachers and volunteers at the SCFW. I have carefully read this waiver of liability and fully understand its content. I agree to the terms and conditions above.
Photo Release
I understand that there will be photos taken at events, classes, workshops and talks and that I, or my children may be included in these photos. You (SCWF) have my consent to use these photos for promotion purposes. If I do not wish for myself, or my family to be included in the use of photos taken I will inform Sundalah (Jasmine Healy-Pagán) in writing (connect@sundalah.com.au) before the events I attend and/or before the 7 April 2024.”

General Site Terms and Conditions
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Site, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services on this site.
Terms governing Goods and Services for Sale
The online store on this Site is hosted on WooCommerce, which is an online e-commerce platform that allows us to sell goods and services (products) to you.

These Terms and Conditions apply to all the products that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our products are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all products we provide. You agree to purchase products from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Third Party Products
The Site may offer products from third parties. We cannot guarantee the quality or accuracy of products made available by third parties on our Site. Complaints, claims, concerns, or questions regarding third party products should be directed to the third party.
Payments
We accept the following payment methods on the Site:
- PayPal (including Credit Card and Debit Card payments through the PayPal service)
When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Consumer Protection Law
Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
Sundalah and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Sundalah and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the State of Queensland.
Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Sundalah are unable to resolve any dispute through informal discussion, then you and Sundalah agree to submit the issue before a mediator. The decision of the mediator will not be binding. Any mediator must be a neutral party acceptable to both you and Sundalah.
Notwithstanding any other provision in these Terms and Conditions, you and Sundalah agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Terms and Conditions document Updates
These Terms and Conditions may change from time to time and are always available on the Site. When the Terms and Conditions are updated, we will change the “Effective Date” at the bottom of this document. We recommend that visitors review the Terms and Conditions on a regular basis if they have any concerns.
